Colorado cancels $100 million BEAD award to Maverix Broadband over fund misuse

Colorado's broadband office canceled a $100 million BEAD award to Maverix Broadband after finding unpaid vendors and payments for materials never received, and is pursuing $3.2 million in missing funds through Maverix's bankruptcy case. Maverix cofounder David Lindauer disputes the state's findings, and Colorado plans to re-bid the 10,000 locations the company was set to serve.

Providers named: Maverix Broadband

Award amount: $100.0M

What this means for BEAD compliance

Maverix Broadband, Colorado's BEAD program office, and other ISPs (especially smaller Colorado providers) that may bid on the 10,000 re-bid locations.

The award cancellation terminates Maverix's active deployment obligations including milestone payment compliance (CO-FIN-004-1), contractor oversight, and procurement/expenditure documentation, while triggering recovery action on the $3.2 million in unaccounted funds through the bankruptcy proceeding. Colorado's broadband office must now document the default and fund misuse findings to support its clawback claim and will need to reissue subgrant agreements for the affected locations, restarting pre-award diligence (financial controls questionnaire, letter of credit, engineering certification) for any new awardee. ISPs still holding Colorado BEAD awards should expect heightened scrutiny of milestone payment documentation and vendor payment verification given this precedent.
