Bipartisan senators press NTIA to release guidance on BEAD non-deployment funds
Sens. Jeanne Shaheen and Susan Collins led a bipartisan letter urging Commerce Secretary Howard Lutnick and NTIA Assistant Secretary Arielle Roth to release long-delayed guidance on how states can use BEAD funds for non-construction activities. The letter was also signed by Sens. Angus King, Bill Cassidy, Catherine Cortez Masto and Mark Warner.
What this means for BEAD compliance
State broadband offices administering BEAD programs and ISPs awaiting clarity on how leftover or non-deployment BEAD funds can be used for adoption, affordability, and digital equity activities.
No new compliance obligations are activated by this letter; it is a congressional push for NTIA to issue guidance, not a program or funding action. ISPs should monitor for forthcoming NTIA guidance on non-deployment fund use, which could eventually affect state subgrantee agreements and reporting categories, but no reporting, procurement, or deployment clocks start from this item. Compliance officers should track this as a watch item rather than an action item until formal guidance is published.
