Bipartisan senators press NTIA to release BEAD non-deployment funding guidance
Sens. Jeanne Shaheen and Susan Collins led a bipartisan letter urging Commerce Secretary Howard Lutnick and NTIA Assistant Secretary Arielle Roth to release guidance on how states can use BEAD funds for non-deployment activities. Sens. Angus King, Bill Cassidy, Catherine Cortez Masto and Mark Warner also signed the letter.
What this means for BEAD compliance
State broadband offices and BEAD-participating ISPs that anticipate using BEAD funds for non-deployment activities such as digital equity, adoption, or affordability programs.
No new compliance obligations are triggered for ISPs by this letter itself; it is a congressional request for NTIA to clarify policy, not a rule change. However, if NTIA responds with new guidance on non-deployment fund use, states and subrecipients could see revised reporting, eligible-use, and cost-documentation requirements that affect project budgeting and expenditure tracking. ISPs should monitor for forthcoming NTIA guidance that could alter how states allocate remaining BEAD funds and any associated subrecipient obligations.
